The special prosecutor in the CIA leak investigation said Monday he doesnt expect the White House to attempt to block Vice President Dick Cheneys former top aide from using classified intelligence material in his defense to perjury charges.
Special Counsel Patrick Fitzgerald told U.S. District Judge Reggie B. Walton that the White House has designated certain documents that it is concerned about being made public during a trial.
If those documents are among those that I. Lewis Scooter Libby wants to prepare his defense, Fitzgerald said, he and Libbys lawyers will work out solutions with the judge in secret under a law designed to deal with defendants access to classified government information.
Libby, 55, was charged last October with lying to the FBI and a federal grand jury about how he learned and when he subsequently told three reporters about CIA officer Valerie Plame. He faces five counts of perjury, false statements and obstruction of justice.Under the Classified Information Procedures Act, Walton will broker compromises between the government and the defense as to what information can be used at trial and in what form. Much of what Libby wants likely will be provided to the jury via summaries of the classified material.
So far, the government has turned over an initial batch of about 55 pages to Libbys defense team, and another group of documents is to be delivered Tuesday, defense attorney John DeWitt Cline said.

This case doesn't go to the courts until January 07; if it ever gets there. I'm surprised the judge hasn't thrown it out yet, but there is still plenty of time to do so.
Isn't it stunning that the judge is entertaining this bull puckey?
Thanks for the ping.

FNC Alert:
Karl Rove will NOT face charges by the Special Counsel.
GREAT news Karl Rove will not be indicted!!! YAHOOOOOO!
I hope it's good news to Libby too, a sign that Fitzgerald is backing down
And Howard Dean says Karl Rove not getting indicted might be good news for the White HOuse, but it's bad news for the country.
What an idiot!!! But how brave, he's on tv this morning, interviewed by Campbell Brown on TODAY Show
It must be a very topsy-turvy day over in DUmmyland, as they were maintaining that Rove was indicted on May 12.
Typical, of course. Bwahaha!
Good news on Rove. And the sham continues for Libby.
DUmmyland, which includes Howard Dean, doesn't seem to get that Rove has the presumption was NOT indicted. LOL
DNC Chair Howard Dean: "If Karl Rove had been indicted it would have been for perjury. That does not excuse his real sin which is leaking the name of an intelligence operative during the time of war. He doesn't belong in the White House. If the President valued America more than he valued his connection to Karl Rove then Karl Rove would have been fired a long time ago. So I think this is probably good news for the White House, but its not very good news for America."
Dr. Demented. The gift that keeps on giving.
