Robber, not burglar; judge would be his better bet, they've got more in common.

We can start a legal defense fund for two of my fellow NYers in the near future...

Nice to see NY hasn't changed since I left...

He'll be in prison but he'll be able to buy the nicest soap on a rope money can buy...

We need a "loser pays" system here like they have in other countries.

You launch a frivolous suit and lose....you pay the bills.

That would put the ACLU out of business.

There should be a law against this. However, to many bleeding hearts and too much money to lawyer lobbyists will prevent a law like this from ever seeing the light of day.

Two career criminals in this case: Dana Buckman and his evil lawyer.

Dana Buckman is back in jail, where we are now safe.

The other has a license to steal, and the public will always be in danger as long as this shameless crook in a $3000 silk suit remains at large.

Let me see here now, two men disarmed the perp, and then one man held a gun on the perp while the other beat the dickens out of him with a pipe. Now the jury will hear that two armed men beat up one unarmed man. Yep, this could go badly for the store employees.

This gives new meaning to the phrase "loser pays."

This low life AND his lawyer have the audacity to try this because LIBERALISM has infected the country. A healthy county and justice system would never tolerate this kind of abuse. Liberalism is a mental disorder, it also brings chaos and darkness.

The only real solution to tort reform in this case is to kneecap his attorney.

And the judge will throw out the case, fine the lawyer that brought it and add time on to the sentence of the perp, right?

What is bad is this is not uncommon.

Several years ago, my 18 wheeler was parked in a truck-stop in Ohio for the night. I felt something and woke up. Quickly pulling my clothes on , I exited the semi and checked it. Someone had broken the seal on my '53 foot trailers rear doors and opened one of them. I could hear him inside the trailer. Quietly moving there, I closed the door and locked him inside the trailer (no inside door release). I went into the truck-stop building and called the Police.

Seems as he never removed anything, he could not be charged with theft. He claimed he smelled smoke and was checking my trailer. At most I might have been able to get him on breaking the seal, but the cops said it would be hard to prove that he was anything but a Good Samaritan.

However, by locking him up, I kidnapped him, which is a felony, so guess who went to jail? The company I was leased to at the time (their trailer, my truck) hired a lawyer. Upshot of the whole thing was that they had to pay him off to keep me out of jail. The lawyer told me that next time, leave him locked up in the trailer and continue on my journey to Illinois. That state would have locked him up for sure (different laws).

The whole experience gave me an opinion of Law Enforcement and lawyers that remains with me to this day.

There's more info from the Rochester newspaper here:
http://www.democratandchronicle.com/apps/pbcs.dll/article?AID=/20060610/NEWS01/606100342/1002/NEWS

I can't quote any of the article because it's a Gannette Snoozepaper. The suing burglar has a lawyer, one Phillip R. Hurwitz, who also represented the burglar at its criminal trial. The employees were not charged with anything for beating up the burglar, and the lawyer for Autozone and the employees thinks the defense speaks for itself in this frivilous lawsuit.

And Dana Buckman isn't exactly a model citizen. He already spent 12 years behind bars for burglary before he was arrested for robbing the Autozone.
