Foiled Burglar Sues Store Employees for 'Emotional Distress'

ROCHESTER, N.Y. A man who was beaten by employees of a store he was trying to rob is now suing.
Police say Dana Buckman entered the AutoZone in Rochester, New York, last July, brandished a semi-automatic pistol and demanded cash.
That's when employees Eli Crespo and Jerry Vega beat him with a pipe and held Buckman at bay with his own gun.
Buckman escaped when they retreated into the store to call 911, but he was arrested a week later. He pleaded guilty to first-degree robbery and was sentenced to 18 years in prison as a repeat violent felon.

They can ask that the suit be dismissed 'with prejudice'. That means it can't be filed again and the only way the attorney can get paid is if his client does it.
But I do think some countersuits are in order against the perp.
Since he's in prison they'll have no trouble serving him.

Did I miss a meeting..you have a right to rob a store???..people beating you..not knowing if you are going to kill them with your gun..should take your word and do what you say???..what gall..john edwards is probably handling this case for the criminal..

We need a "loser pays" system here like they have in other countries.
You launch a frivolous suit and lose....you pay the bills.
That would put the ACLU out of business.

There should be a law against this. However, to many bleeding hearts and too much money to lawyer lobbyists will prevent a law like this from ever seeing the light of day.

Two career criminals in this case: Dana Buckman and his evil lawyer.
Dana Buckman is back in jail, where we are now safe.
The other has a license to steal, and the public will always be in danger as long as this shameless crook in a $3000 silk suit remains at large.

Let me see here now, two men disarmed the perp, and then one man held a gun on the perp while the other beat the dickens out of him with a pipe. Now the jury will hear that two armed men beat up one unarmed man. Yep, this could go badly for the store employees.
