As you rightly point out, what is intuitive is not always easily explained ESPECIALLY when an explanation has never been required before... e.g. imagine if one was sued for eating breakfast in the morning -could one readily explain why they do so, why it is best?
One thing I note as odd in this whole debate is that regardless any proofs or explanations posited by either side of the argument -LEGALLY, it should be the side wishing to overturn precedence well documented historically that burdens the proof and explanation. OTHERWISE, the terms "Status Quo" & "Stare Decisis" become meaningless AND we are no longer equal under the law but instead accepted or rejected under the whim of a tyrannical judiciary...
