If the child is under 14 and the perp is over 18, then it is first degree rape. If the child is over 14 and under 16 then it is second degree rape. After a child reaches the age of 16, it is not rape if consentual.

It has been said on this thread that the Supreme Court overturned death penalty statutes for rape. Why do you suppose this would be any different?A lot depends on the make up of the SC and the way the OK law is written.
Is there something in the constitution of the U.S. specifically that you view as forbidding this type of law?

It will, at the very least, deter those convicted and punished for their second offense. Not great, but better than catch and release for third-time losers.
