That means that the National Guard may serve only in support functions, unless the Governor of a border state declares a state of emergency (however named under local law) and uses his or her her National Guard to perform law enforcement

In Texas, increased attempts at crossing over the rumored forthcoming amnesty could qualify as an emergency. Rounds fired at TNG/TANG could also constitute an emergency. Thanks for the clarification.
