So, turning the words of the Founders from "shall not be infringed" to "ok, well the States and Cities can infringe on a BASIC HUMAN RIGHT" isn't creating new meaning out of whole cloth? I'm not asking you to accept my interpretation, but I am asking you to accept THEIRS.

After all, Marshall didn't write a single word of the Constitution. Nor did he vote on a single provision.

Now who's word are you going to take? Theirs? Or a Judges?

Never mind. You are unwilling to even entertain the idea that your hero worship of Marshall may be blinding you to the fact that he got this one wrong...

'Tis better to have a REAL hero for hero worship than some crackpot. Marshall was the greatest legal mind (other than Hamilton) which our nation ever produced.

Civilization requires the infringement of many "basic human rights" as you would find out should you decide to walk naked into city hall. Many of our rights are severely infringed as soon as we leave our homes. You have no "right" to fire a weapon anytime or anyplace you wish no more than you have the "right" to yell fire in a crowded theater.
