Capitol police investigate motive behind story By Casey Ross Saturday, May 6, 2006 - Updated: 02:16 AM EST
Police are investigating whether U.S. Rep. Patrick Kennedys bizarre crash-scene story about being late for a 2:45 a.m. vote was a desperate attempt to escape an OUI bust by invoking a law that prevents members of Congress from being arrested while en route to formal sessions, authorities said.
Kennedy, who yesterday admitted an addiction to prescription pain medication, told officers upon emerging from his Mustang convertible Thursday morning that he was late for a vote, even though formal business had ended hours earlier, according to a police statement.
There are a lot of different thoughts as to why he said that, Capitol police officer Mike Killough said. Were looking into what he stated and what other people have to say about what he did that night.
Killough said police are careful to observe a provision contained in the U.S. Constitution that protects members of Congress against arrest while traveling to and from formal sessions.
The constitutional provision includes exceptions for felony or breach of peace - which could apply to Kennedys actions, depending on what investigators find - but Killough said cops typically use restraint when Congress is in session.
You can always take appropriate action afterward, and we have in the past, he said.
A hostess at the Hawk n Dove bar, a popular Capitol Hill watering hole, told the Herald that Kennedy was drinking in the hours before cops say they watched his Mustang swerve eratically, nearly hit a police cruiser and smash into a concrete security barricade.
Kennedy said he did not drink alcohol before the accident and instead blamed his actions on a reaction to the sleep medication Ambien and a gastroenteritis drug called Phenergan.
After initially saying he got behind the wheel because he was disoriented and believed he needed to vote, Kennedy said yesterday he has no memory of getting out of bed or crashing his car.
Conflicting statements
U.S. Rep. Patrick J. Kennedy (D-R.I.) seemed to remember a good bit about his Thursday morning car accident on Thursday evening. But by Friday afternoon, his memory was failing.
THURSDAY: Following the last series of votes on Wednesday evening, I returned to my home on Capitol Hill and took the prescribed amount of Phenergan and Ambien, . . .Some time around 2:45 a.m., I drove the few blocks to the Capitol complex believing I needed to vote. Apparently, I was disoriented from the medication. At that time, I was involved in a one-car incident in which my car hit the security barrier at the corner of 1st and C St., SE.
At the time of the accident, I was instructed to park my car and was driven home by the United States Capitol Police. At no time did I ask for any special consideration, I simply complied with what the officers asked me to do.
FRIDAY: I simply do not remember getting out of bed, being pulled over by the police or being cited for three driving infractions. Thats not how I want to live my life. And thats not how I want to represent the people of Rhode Island.
Perhaps (and I can show no proof for this) the biggest scam in America is that in some states ... there are NO elections.

The double-standards and hypocrisy of Dem crimes vs GOP crimes is absolutely incredible.
You know as well as I do how they came up with the cockamamie story about Ambien. The first public statement was a disaster; perhaps the Kennedy family attorneys got involved and hurriedly researched the internet for a "prescription drug" excuse. Ambien has been in the news lately although only a tiny fraction of its users have had the supposed side effects. Presto, a day later, a new excuse and Papa Ted ("Patrick, can you use this neck brace I have in the closet") is so "proud" of his son for stepping forward to get treatement for this awful thing done to him by the drug companies. All but the most gullible (and the willing helpers in the press) can see through this garbage.
You mean, like Joe Sr's thriving business smuggling booze during Prohibition? If he hadn't been a smashing success there (achieved by being ruthless enough to succeed in a mob/gangster/criminal enterprise) there wouldn't have been the financial backing to produce the degree of infestation of Kennedys the country has now.
But where Joe's was red-blooded, bare-knuckled, dog-eat-dog crime, his spawn have weakened to predatory, bullying, inflict-suffering-on-the-weak-and-play-for-sympathy-later crime (oh, did I just describe many congressthings?)
Give this a week and it will blow over. Whans the last time you heard a report on Cynthia McKinney striking an officer. Politicians know the American public has short memories. If you survive a week its all done with.

I can keep up with all the Kennedy spawn but isn't this the same Kennedy son who went to the courts with his sister and was made guardian for his mom due to her drinking? Is he one of the one's involved with trying to have her committed when her tried to sell some of her own property?

He knew exactly what the hell he was doing by claiming he had to vote at 3 am so as to try and thwart law enforcement.
1. That is abuse of power.
Further, we now know he was drinking at this bar before the accident.
He issued a statement Thursday saying he had consumed "no alcohol prior to this incident."
2. That is an outright lie compouned by making a false statement, and he issued it from his office while in an official capacity.
It is unreal to me how much his father got away with. Look at the fawning media coverage he recieved after he killed Mary Jo.

You are very correct in your assessment. I was reading the posts at DU regarding this mess, and they are very, very upset and angry.
They thought they had it all wrapped up after Duke Cunningham's conviction. Duke disappointed many of us. Even a fool knows a week is a lifetime in politics.
After McKinney, and now this, the Democrats look like complete jack asses.
