What I don't understand is EVEN IF it were pills, that is still DWI.

My father was convicted of DWI for having a heart attack while driving and they found Xanax (prescribed to him) from the PRIOR night in his system.

Either way, he was driving while intoxicated, that is ILLEGAL. If they let Cynthia McKinney (which we all know they will) get away with her crap, and now Kennedy his...

Then we will know we have reached the Lords and Ladies days again. The Barons can do as they will.

Was your father driving himself to the hospital? Did the cops actually stop him while he was having the heart attack? Did they get him to the hospital?

Why is this the strangest post I've read all day?

You are correct. I arraign people all the time for these sort of arrests and it is "Under the influence of alcohol or controlled substance." Its all a crime.

I'm not knocking your dad and I'm sory tyhis was done to him, but he must have had the worlds dumbest lawyer in court. A doctors statement should have had the charge tossed.

Xanax has a usefullness or bloodstream active life of no more than 8 hours tops actually closer to 6. The residue bloodstream life may be longer but it would have zero effect on the person.

I take 4 of them a day and drive every day. No wrecks, one speeding ticket, but no problem driving taking Xanax. Actually I can't drive without it. It's supposed to be the doctors and the patients descretion whether or not a person can drive taking it. IOW wheter or not that person will be impaired. Someone who uses Xanax on a regular basis is less likely to be impaired as the body adjust to it. For that matter the cops could issues tickets for taking SSRI's etc as well.

Xanax used for treating sensory disorder induced anxiety, used for heart patients, but it's also used to treat certain forms of seizures. The case should have been tossed. I've been stopped before and asked if I had any medications on me etc and I say yes and show the prescription. No problem. I've taken it 12 years.

The dosage your dad would have been taking was likely .5mg. If he was taking more than that strength just once a day he'd be having some major problems from chemistry swings. .5mg isn't gonna make him stoned. Heck I can take 1-1.5 mg within 30 minutes time and not feel it. Xanax doesn't do a person like Valium does. Dumb cop dumber judge.

Absolutely.

And he lied to the cop about having a vote to make, as well.

And his story changes . . . last I heard, he was claiming to have been on pain killers. And doesn't remember (now where have I heard that before, Hillary?) getting up, the crash, or being ticketed. And he's going into rehab. And people should understand that he's battled depression and drugs all his life. And he has done wonders to raise awareness of the problems people face.

It's enough to make you wonder if in all of Rhode Island there isn't one sober person they could elect to Congress. But that question doesn't matter - he's entitled to a seat in Congresss, if not the presidency, 'cause his granddaddy was Joe Kennedy. </sarcasm>
