I can't seem to find a flaw in that premise.

It is deeply flawed because it does not take into account the Creator. There are many, many rules that say what you can and can't do with your body (ingest heroin, rent it for sex, have it unclothed in public, etc. etc). Further, who defines what a "basic human right" is? Is it some ethereal concept of a thing? A "right" is a legally defined state of being. The US Constitution defines them as Life, Liberty, and the Pursuit of Happiness, and was intended as a reflection of God's devine law. We suffer too much from the cavilier way "basic human right" is slung around without validity, precedent, or moral authority.
