That would be important if it was true. You can be a member of a conspiracy and be JUST as guilty of murder as the one who pulls the trigger. The concept is called felony murder and the Judge seems to be forgetting basic common law.

So..under that rule- theoretically bin Laden would get life and not the death penalty. He did NOT participate directly in the attacks- he was in Afghanistan.
Not sure about this- under Federal law- is conspiracy to commit murder a death penalty case?
