Shooting down the gunmakers
New York Daily News ^ | April 30th, 2006 | MEATHEAD Editorial

Posted on 05/01/2006 3:35:31 PM PDT by neverdem

Sharp shootin' Jack Weinstein, judge of the Eastern District, has used a silver bullet to single-handedly keep alive Mayor Bloomberg's battle to get illegal guns off the street. The judge rightly ruled that the city can use federal data it already has against gunmakers and distributors who carelessly deliver their wares to unscrupulous dealers who, in turn, sell to criminals. Weinstein is the man in the white hat against the firearms black market.

It was the second time the judge rode to the rescue against gun-industry puppets in Congress. Which only shows how afraid the National Rifle Association and its lackeys are of a lawsuit that seeks to declare negligent dealers a public nuisance by using numbers pried from the Bureau of Alcohol, Tobacco, Firearms and Explosives.

The first time, in December, Weinstein ruled that a new federal law limiting gun-industry liability does not apply to the city's suit. That law, ludicrously dubbed the Protection of Lawful Commerce in Arms Act, was passed solely to grant amnesty to gunmakers and distributors who know their deadly products are funneled to criminals and sell them anyway. Weinstein was having none of it.

But even before he could rule on that piece of nonsense legislation, the NRA's lapdogs fired off a second salvo. This was a rider, secretly added to an appropriations bill, making it illegal for the city to use its ATF data as evidence. In quite effectively making the case, city lawyers had utilized the feds' own numbers - like the fact that 60% of guns used in crimes trace back to 1% of the arms merchants. Now, Congress was forbidding any use of federal firearms-tracing info.

Weinstein, angry at being sandbagged, shot that down, too. On Thursday, he ruled that the language of the rider applied only to new information, not to data already in circulation. And he took a swing at Congress, noting that its own rules require fairness in the gathering of evidence, without unjustifiable expense or delay. Ride 'em, cowboy.

That must be the modern, PC version of that movie quote. :)

When the Brady Bunch has to get their media lapdogs to run pieces of tripe like this, we know they're running scared!

Even the Dimocrats have disavowed their previous gun-grabber platform, and the Brady Bunch has nobody to turn to except Chuckie Schumer.

It's over! The Second Amendment has won!

Yes indeed it has. Simply because its a sure fire way to get unelected. Ask AlGore who lost his own state. We need to make the Illegal invasion have the same effect. We need to make the (our) politicians fear to touch it.

distributors who carelessly deliver their wares to unscrupulous dealers who, in turn, sell to criminals who, in turn, even if they are arrested and put on trial are let off on a technicality by left wing judges so they can go back to terrorizing the general public.

I would not be surprised if 1% of all the ever-licensed FFL's sold close to 60% of firearms, period.

If New Yorkers could legally obtain firearms for self-protection (and use them on criminals), there probably wouldn't be a black-market for firearms.

No, it's not over. You have to understand something about the left: They are like the liquid-metal asassin in "Terminator II." No matter how many times they are seemingly destroyed, they always reconstitute and attack again. We cannot let our guard down with this bunch for even a second.

This case described is yet another example of how they operate. Having failed to stop the legislation, they now turn to a black-robed mullah to carry out their wishes. It's also a mistake to characterize the law as a great victory or advance for the second amendment. It was a more-or-less successful defensive action against further encroachment by the likes of the detestable Bloomberg, et al. While it's a good thing this law is on the books, it did not roll back any of the numerous encroachments against the second amendment enacted by the government over the last 75 years.

Has the Gun Control Act of 1968 been repealed? Has anyone even introduced legislation to do so? How about the odious provisions found in the "Violence Against Women Act" that forbid firearms to anyone named in a "protection order" - not convicted of any crime, mind you, just named in an order issued by a judge, the majority of whom are Marxists to begin with. The Republicans in Congress dutifully renewed this stupid law last year, naturally. It would not surpise me one bit to see some judge like the moonbat mullah in the arcticle name every member of the NRA residing in his jurisdiction in a protection order. Federal judges are utterly out of control, and the congress refuses to impeach and remove even the very worst of them.

Until conservatives understand that folks like Bloomberg and Schumer are enemies of this nation every bit as much as Osama Bin Laden is, all we'll do is fight defensive actions. We must remind ourselves daily of what the former Marxist David Horowitz said - "It's a war, stupid!"

I have no problem with going after gun dealers who sell guns illegally. However, to go after the gun manufacturers is without precedent.

Using the same logic, you could go after car manufactures for selling the cars most commonly used to kill people on our highways to car dealers.

In fact, that just might be a good lawsuit to file....

Take away our weapons so it will be easier for the illegal immigrants to take over. Congress will put all whites in gas houses like the Germans did the Jews before this century is over.

It's never over.

Defeating gun grabbers is like defeating communists (but I repeat myself) they just adjust their tactics and lie, lie, lie.

It takes a Leftist to praise a judge for illegal and unconstitutional action.

We need to make the (our) politicians fear to touch it.

That's why RINOs need to be eliminated in the primaries. History seems to be catching up to GOP

Dates and number of seats available for Senate and House primaries follow the story.

Well said, my friend!

The Left is like a mindless Borg... once it gets an idea in its head it doesn't care how many people get killed in the process of implementing that idea. It will stop at NOTHING.

This fight isn't over by a long shot. Socialists and Pacifists are working DAY AND NIGHT to disarm and pacify the US population. Never forget that.
