I think it will play out like this :
After the election, the accuser will refuse to press charges or go to trial, saying she cannot go through reliving all that again. (Thus,she will not have to testify under oath.)
Then, she and Kim will sue the Duke players and DU, etc.,
in civil court.
(This is the strategy followed by Kobe Bryant's accuser.)
In the end, Kobe had to pay a settlement to avoid the risk of going before a jury. (Juries can decide anything, even that a celebrity ought to pay a poor girl something, even if he is not guilty.)
So the Duke players' families will be under tremendous pressure to make a pay off, just to be able to end this
and get on with the rest of their lives (and to avoid
the risk of going before a jury--especially in Durham, sad to say). It is a no-risk proposition for the accusers
and their attornies.
