Yes.

I do think that the government is probably going to have to sanction her. The difference here is that she will get a fair trial under the rule of law and a dose of mercy.

I do not believe a conviction can be had. She may have violated the law, but in this case, as the saying goes "the law is an ass". It clearly, if applied in this case, is limiting her first ammendment right to free speech. Further, it is specifically political speech. Particularly with the new make up of the Supreme Court I do not think even a conviction would survive the appeal.

I suspect the prosecutors will figure all this out and drop the charges, particularly if she hangs tough and refuses to cop to a lesser charge. As she should.
