Do you think his giving 70 interviews proclaiming that she WAS raped is proper behavior for a DA w/OUT any verified DNA evidence and BEFORE charges have been made?
I think it's funny/sad that the boys are morally judged for hiring the stripper, yet no one can question the woman's "profession."

This became political within hours of the 'rape' being reported.
Not only was there no DNA, the test indicated that the stripper had not had sex in several weeks. Game - Set - Match.
There was not only no semen, there was also no perspiration, saliva, hair, tears or blood. How did he get a warrant? That's what a lot of people would like to know. The "Probable Cause" here is probably fiction. The DA will never
win the upcoming election.

Rush used only Nifong quotes from yesterday that showed Nifong pandering to the black audience at NCCU. He did ~not~ use the quotes in which Nifong confronted some audience members. I generally agreed with Rush's remarks but they were far from "fair and balanced." They were selective and pandering to our side.
Rush also put a good bit of sarcastic emphasis on the on-going DA's race. As Nifong himself said, he does not get to choose the cases that come before him. My sense is that he did not cynically seek to ride this case to election. It was explosive and the community -- black and liberal white -- was in an outrage over perceived lack of action. I really don't think any DA could have been expected to silently sit out this uproar, elections or no elections. Nifong had to speak out, which is not to say that he hit quite the right note.
The upcoming election and this event can never be teased apart. Ofcourse, Nifong wants to look strong in front of his constituency. If he sat silently through this, he would be politically hammered to death.
In general, the SOP for these things is that if the alleged victim insists on following through with the case, the DA usually complies in spite of the evidence unless he's faced with hard proof that the accuser is lying.

Sheer unadulterated baloney. Asst. District Attorney Frieda Black usually tries the murder and rape cases in Durham.
However, Nifong CHOSE to try this one. (Not so incidentally, Frieda Black is running against him for the DA job in the May 2 primary.)

The moral, ethical, or previous criminal background of the accuser can in no way be taken into account when prosecuting the case, or in the initial defense of the charges by the accused. Trust me, we learned the hard way when our son was among the top ranked quarterbacks in the nation and was accused by a young black woman of trying to assault her. You'd be amazed what's going on in our country today and who's getting by with it. The fact that our son's accuser was linked to stalking other atheletes, threatening others and assaulting others before and after she went after our son was in no way taken into consideration. Believe me, the race card fell with a thud when she threatened to bring in Al Sharpton. We knew we'd been had and big time. I'm still paying off the legal expenses and darned near went bankrupt to save a great young man.

The underlying assumption being of course, that this is acceptable survival behavior for a poor, black female in an oppressive culture dominated by white, Christian males. In this case the elite media gets a bonus adjective in that they are presumed to be "southern" white, Christian males.

Here's something I heard last evening on the local news: It seems the players have volunteered to take polygraph tests to prove their innocence. Knowing it can't be used in a court of law as evidence, the DA would be smart to allow this and also ask the victim to take the same test. That could be a way out for him.

We need to bear in mind that he received this case with a complaining "victim" making a sworn allegagion, a strongly -- although not conclusive -- substantiating hospital report (from a trauma center supposedly expert in these matters), and the behavior of the LAX team that lent a certain plausibility to the whole episode. Most people thought, early-on, as did Nifong, that this was a real crime.

I ~did~ hear him ~yesterday~, at length, and thought that his comments -- taken in their totality -- were not unreasonable. He sounded to me like a prosecutor, who happens to be a liberal and who has made some mistakes. My impression is that he wants to do an honest job. When it looks to everyone like a gang rape, I don't really fault a prosecutor for saying he would vigorously prosecute. And he was under enormous pressure. I expect that he wishes now that he had been a little more restrained.
