The probability of any panel reaching an accurate conclusion is very, very , VERYVERYVERY low. Do you think there is a representative from Al Quaeda who is going to stand up and say anything? Do you think there is going to be a documented stream of data? This is all cloak and dagger.
If I was in the Saddam drivers seat, I too if under scrutiny or perceived potential scrutiny would destroy any and all incriminating evidence. I would disband all groups involved and destroy all records. All WMD's would be destroyed, buried, or shipped to an aly such as Syria.
The panel has to rely on evidence and here there is a massive hole. Without evidence they have to reach a conclusion based on what they have.
This does not mean that collaboration did not exist. It only means that the investigators do not have any documents, or could not interpret what they have.
