This is a little strange, that a proprietor would be held responsible for a tenant's wrongs.

God,they *still* think that their problem is "pirating". Their problem is that it's been at least 20 years since anything worth buying has come out of a recording studio.
To: tsomer
It's not like THIS tenent was behind closed doors. Also, the flea market had it's own employees working throughout the place.

Their problem is that it's been at least 20 years since anything worth buying has come out of a recording studio. That's not true. If it's worth it to someone to steal it, than they ought to pay for it. If the problem were lack of demand, then people wouldn't be pirating.

But should a owner be responsible to inspect every item sold in a flea market? What happened to personal responsibility?
Daytona Flea market is huge (see their website). It would be stupid to think the owners could police EVERY item sold to make sure it's not "hot".

Their problem is that it's been at least 20 years since anything worth buying Exactly. I can't even remember the last time I bought a new studio recording, as opposed to a "Greatest Hits" or "Anthology" CD.
It's always technologies fault, not their product. I mean, the MSM still thinks it's only the internet causing their falling readership and not their left wing bias. Same thing goes for Hollywood.

If it's Wednesday, it must be California. From the article:
The decisions is similar to a 2004 ruling from a federal judge in California that found the Marysville Flea Market liable for all the pirated music sold there.
More fallout from the Digital Millennium Copyright Act and the Grokster case.

This is quite a precedent. Now lawyers can gain ownership of all the shopping centers in the country!

You know, that McDonald's food isn't very high quality. They haven't put out food worth buying in years. Therefore, I think I'll go steal a Big Mac. Makes a lot of sense.

How do you know they weren't pirating Guy Lombardo or the Andrews Sisters?

Having discovered the CD burner a few years back and an outstanding source of CD's of the music I like,I've built up a great collection of stuff that I love.
Very little of the music in question was important enough to me to compel me to pay for it..particularly with CD's that have only one song on it that I like.

If it's Tuesday, it must be New Jersey. Actually, if it's Tuesday, you should learn how to read:
U.S. District Judge Jerome M. Simandle issued a written opinion

Exactly.
This seems to set a bizarre precedent that holds the proprietors of a flea market, rather than the vendors who are renting space, responsible for every item sold.
If a vendor sells a stolen watch, can the flea market be held liable?
If that is the case, why in the world would anyone operate a flea market? Surely every one on the planet of any size has a hot item or two sold by at least one vendor.

More like "you know that McDonald's food isn't very high quality. They haven't put out food worth buying in years." Therefore, I think I'll go buy a hamburger from a local grill that sells an imitation Big Mac and even calls it a "Big Mac" on its menu.

God,they *still* think that their problem is "pirating". Their problem is that it's been at least 20 years since anything worth buying spending more than $2 for at a flea market has come out of a recording studio.

The last CD I bought was a gift for my little brother a few years ago.
I haven't bought music for myself in a long time.

How 'bout this analogy: GM hasn't made any cars worth a damn in years. So I guess I can go steal as many as I can without guilt.........

The last CD I bought was a gift for my little brother a few years ago.I haven't bought music for myself in a long time.I now have a music collection that includes about 95% of the songs that mean anything to me...and I'm a music lover like you wouldn't believe.
As a result,I can't see myself spending much on recorded music at any time in the future.
