Technically, it makes no difference. The Mexiweasel, although certainly traitorous, has not been convicted of any offense and still enjoys the protection of statute.
In reality, I rather doubt the prosecution can find 6, 9, or 12 people sufficiently besotted to vote to convict for what is, again technically, arson.
