well i don't know the law in DC but here it sure isn't an assault unless there's some injury.
From what I remember, assault can even include words. BATTERY is the act of physically touching another without consent.

yeah that's why i said i don't know the law there. we don't have battery in new york as a criminal offense. they may have that there. then it would be a crime.
