How is Mahoney advocating breaking the law.
What he said he would resist is any provision such as the one contained in the House bill, passed in December, which said that priests and those in ministry who deal with Hispanics would have to ask for "papers." They would also risk jail if they ministered to someone who was unable to produce those papers.
Thankfully, that draconian provision has already been voted down by the Senate and will not be included in any bill coming out of that body.
And, it will likely not be part of any final bill.

that he would instruct his priests to defy legislation if approved by Congress that would require churches and other social organizations to ask immigrants for the legal documentation.
That means breaking the law should it pass.
The House bill already passed. Whether it survives the Senate...and what we saw yesterday, I will agree with you...I doubt it will.
