arrested for being drunk in a bar? whats next, being arrested for being wet in the bath tub?

Are you going to sleep in the bar or drive home? Get them in the bar before they head home.

I always wondered why the police don't just wait outside the bars at closing time, then nab the drunk drivers as they drive out of the parking lot. No brainer. Maybe because some defense attorney will argue entrapment? Who knows? Any DUI/DWI attorneys out there?

" Are you going to sleep in the bar or drive home? "

I can think of lots of options...taxi, designated driver, etc. Going into bars to arrest people for being "drunk" to "prevent" drunk driving is just plain stupid. Especially since some of the people arrested in this sting were businesspeople drinking in the bars of HOTELS where they were registered guests. These people obviously were not intent on driving; they were already 'home' for goodness' sake.

They busted people in a hotel bar that were staying in the hotel, so it's about more than stopping drunk drivers. And the Texas statute for public intoxication says the person has to be a danger to themselves or someone else. If someone is at a bar and is part of a group with a designated driver, or is going to take a cab home, and is not trying to start a fight or is falling down drunk, these arrests exceed the state's statutory authority.

What if they have a designated driver? Or if they get so drunk, they decide to walk home? I am suprised you're for this when it is happening in your state.

The other two options, of course, are to take a cab or use a designated driver which many responsible people do.

Never heard of taxis? designated drivers? Sober friends? You are seriously making the assertion that someone who is drinking in a bar is going to drive drunk?

Just out of curiosity, would you support a reinstatement of Prohibition?

"Are you going to sleep in the bar or drive home? Get them in the bar before they head home."

Well, now. As a matter of fact, some of these arrests have taken place in hotel bars, where many of the patrons would be likely to just get in the elevator and go back to their rooms.

Get real, please.

How do you know they were going to drive? And how could the cops? Ever hear of 'designated driver'? That's what's horribly wrong with this.

I'm guessing that you're smart enough to know that those are not the only two possibilities:
Taxis come to mind, especially for business travelers, as several of these were.

Also, several others arrested were registered hotel guests, arrested in the bar at the hotel where they were staying!

Mike Gallagher had one of the Dallas criminals on his show.

The man arrive into DFW and his luggage was "lost". He checked into his hotel and washed up. His luggage was later located and he had to go back to the airport to collect it.

By the time he got back to the hotel, the restaurant had closed. He ordered a burger in the bar and drank 5 beers. Mind you he had no car and was staying at the hotel.

He says that news crews were waiting outside to film the men who were being arrested for PI (shades of the Waco raid). He was not offered a breathalyser test (even when he asked to give one).

Mike also had on a spokeswoman for the TABC. She said that the men are asked by plainclothes officers to step outside so that the test can be administered. To me they do this because while they claim that the bar is a public place, they know that getting the mark to go outside means they ARE in public.

Mike said that he does not drink but that he opposes this program and that a similar tactic and been tried and shouted down in Virginia.
