They weren't in public (property owned by the government). They were in private establishments. Technically, if the cops can arrest them for being drunk in a privately-owned bar, they can arrest them for being drunk in their houses.

That was my thinking, bars are private establishments. We used to live in a subdivision where the roads were owned by the homeowner's association (don't get me started on that! a bunch of Nazis! Now we live on a farm), anyhow, the police couldn't ticket because they weren't county roads. Someone posted that this sting was set up to catch DWI's. I'd say they overstepped by a mile. Also, attributing intoxication to three or more beers? That's subjective. I'm 110 pounds, if I drank three beers (although I can't stand the stuff) I'd be rolling under the table. It would probably just make my husband burp!
