What I think happened in this case is he did what 1000's of other illegal overstays do. They recieve a notice and then do not show up to court (false address etc).
The operative fact is that they are not LEGALLY in this country and you have to LEGALLY enter to have the benefits.
The author of this article is incompetent.
I agree with that statement but unfortunately many state governments do offer benefits to illegals at the expense of citizens
