Stretch misses the point: It's Legal! Everything else is pandering. IMO, York's analysis in that piece, and therefore his conclusion, is fatally flawed and easily shown to be so. FR discussion is at Its Legal by Byron York, and my (minority) position is summarized at post 14 therein.
