Wal-Mart In Court Fight Over 'Wal-ocaust' T-Shirts

ATLANTA -- A Georgia man has filed a lawsuit against Wal-Mart in federal district court in Atlanta in a fight over his T-shirts that compare the retailer's business practices to the Holocaust.

Charles Smith has been marketing shirts that read, "I (heart) Wal-ocaust" T-shirts. Wal-Mart filed a cease-and-desist order in an attempt to make him stop printing the shirts.

The company said Smith is engaging in trademark infringement. It has threatened to sue Smith if he continues to display the logos on his Web site and to print them on his products.

The 48-year-old Smith is a computer repairman and said he has no deep connection to the company. But he claims using the logos is a free speech issue.

Smith said he came up with his anti-Wal-Mart logo after conversations with a customer and an employee who both had bad experiences with the retailer.

He designed his first logo in July. One shirt -- with "Wal-ocaust" printed above an eagle and a smiley face sold on Nov. 16 and netted Smith $5.10.

He said if the court sides with him, he will use any profits to pay his legal fees and for continued production of the products.

Wal-Mart spokeswoman Sarah Clark said Smith is infringing on the company's trademark and also "making an offensive association between Wal-Mart and one of the greatest tragedies of the past century."

Actually, I don't think too many American Muslims are all that attached to.....
In fact, our support for those leaders seems to make some of them angry....

What worries me is that the American Muzzies are just too damned quiet! There's supposed to be millions of them, but all you ever hear is CAIR's spokesman. They mill about in their mosques "minding their own business?" Maybe. But I expect Americans to be loudly bitching about stuff. Potholes. Taxes. Schools. Something. Atta and Moussaoui, those guys kept their heads down, too.

Their Sam's stores do make you feel like you are in the Gulag. First you check out. Then some idiot at the exit checks your buggy to make sure you aren't stealing anything. On top of that, you have to pay a fee to join the darn thing. I stopped shopping there a few years ago. I felt demeaned.

Do you also not shop at the more trendy Costco who has the same procedures?

And BTW - you never did explain you statement that WM is not a friend of conservatives.......care to do so now?

WalMart is buying the conservatives to fight the unions. I have been at the meetings when the WalMart rep is working with the local Republican party and no one asks any quetions except how much.

When the union are done in we will find our jobs gone and China making everything we need to live. I hate the unions but no enough to send my job to China.

WalMart pays people to keep track of the debate on the web. Do you work for WalMart?

It is very obvious you have not paid any attention to the Wal-Mart threads here on Free Republic or you would have saved yourself the embarrassment of asking that question. A question that based upon your comments was meant in a derogatory fashion.

But since you are unwilling to make the effort to look into things before posing such accusatory questions, I will tell you what everyone else who regularly participates in these threads already knows........I do not work and have never worked for WM, nor do I own any stock in the company.

I happen to be at odds right now with most of the members of the local Republican party who are siding with the unions to keep WalMart out of this county. And there are NO unions in this county except government workers.

Peddle your anti WM crapola elsewhere, you have no clue what is going on where I live.
