The Dersh wrote a pretty good book on whether pre-emption is justified. He thinks it is but would like laws to be drafted to give government officials guidance on when to take "gray area" action. Of course he's a liberal but apart from his book on the 2000 election, his output has only gotten better with time.

Shouldn't it be U.S. Citizens, not U.S. Residents? I have a pet peeve when our U.S. Constitution's protections are afforded to everybody, including illegal immigrants and people halfway around the world.

It should instead only apply to those who have given their allegance, either explicitly by swearing an oath, or implicitly, by being born here. Does anyone have any court decisions/precedents on this subject? I think a lot of the stupid issues in court nowadays (welfare for illegal aliens, wiretapping, etc.) could be solved by the simple rule that "The Constitution only applies to U.S. Citizens. If you are not one, then you're SOL."

Alan Dershowitz doesn't deserve a barf alert. He's actually one of the more reasonable and thoughtful libs. What did he say that you felt was so barf-worthy?
