Transsexuals can choose jails 05/03/2006 18:29 - (SA)
Madrid - Transsexual inmates in Spain soon will be able to serve their sentences in facilities for men or women according to their "psycho-social identity", and not according to their original gender, reported the El Pais newspaper on Sunday. According to the centre-left daily, a directive is about to be published concerning the incarceration of individuals who have undergone a sex change. Transsexuals would be able to ask to serve their sentences in prisons corresponding to their new gender, and prison authorities also would address them by their preferred name, according to the report. Prison officials would conduct an inquiry to confirm the sexual identity of the prisoner, notably by requiring the inmate to show proof of having started the sex change at least one year before being jailed. Mercedes Gallizo, the director-general of Spain's prison administration, had already expressed her desire to make these changes in the prison system. Spanish prisons house about 40 female transsexuals, who were formerly men, but no cases of the opposite sex change, according to the newspaper. |

Well, I guess we can't just go around insulting 'transgendered' criminals by putting them in the 'wrong' jail now, can we? (barf)
(hopefully I don't need to add the "sarcasm" tag to that......)

Aren't there are a lot of guys who would be willing to pull a Corporal Klinger to get into a women's prison?
Just thinking off the top of my head...but...

"Prison officials would conduct an inquiry to confirm the sexual identity of the prisoner, notably by requiring the inmate to show proof of having started the sex change at least one year before being jailed."

So I guess if a guy pretends to be a transexual to get into a prison filled with woman prisoners it's ok?

I don't know how the selection process works, but you might wind up in a women's facility where they can kick your butt, or gang-rape you. Best thing is to never go there.

Yes, I saw that. but what does "starting sex change" include? Taking hormones and seeing a therapist? Both of those are completely reversible by just quitting I think.

Who cares which jail, as long as they lock the perverts up?Some people may object to such a Governmental policy shift on the grounds that it not only legitimizes what many consider to be a "lifestyle choice" or a mental disorder but also becomes another weapon that criminals can use to manipulate the system when they are placed in that system for the express purpose of limiting their ability to manipulate the world around them.
Regardless of what body parts you have a surgeon hack off or add, every cell in your body contains DNA that specifically identifies you as male or female. Therefore, these gruesome surgical procedures don't actually change your sex, they are merely exercises in carpentry and remodeling if you will, without changing the essential foundation or framework of the house..
So, all of this ultimately comes down to it being essentially the state of mind that the person is in which determines their 'gender'. and so which prison they are sent to. Some find it objectionable to make such determinations based not upon physical reality but on a person's state of mind.
We already have a precedent of clinically deranged criminals being sent to prison mental hospitals, but this circumstance will be dictated by a clinical diagnosis of insanity. Here in the USA the American Psychiatric Association removed homosexuality from a categorization of mental disorders a few years ago (without the usual scientific studies and factual rationale....it was an entirely political move).
Therefore, we now have a situation where a criminal's state of mind and / or lifestyle choice is allowed to dictate their type of incarceration but it's not being done on the grounds of it being a mental disorder. Many view this sort of thing as being an erosion of the severity of the penalty being served (a woman's prison might be viewed as preferable, on numerous levels, to a men's prison)
