U.S. Appellate Court upholds petition on placing 'Jerusalem, Israel' on passports

WASHINGTON - Menachem Binyamin Zivotofsky of Jerusalem, just 3 years old, emerged victorious last week in his battle with the U.S. administration - a small and perhaps temporary victory, but sweet nevertheless. The U.S. Court of Appeals upheld his arguments and decided to send his case back to the U.S. District Court for the District of Columbia, so that "both sides may develop a more complete record relating to these and other subjects of dispute." The two parties are the child (and his parents, Ari and Naomi) and U.S. Secretary of State Condoleezza Rice.

All said, the ruling is a technical one: Zivotofsky has an argument worthy of deliberation, the judges decided. Via his parents, Zivotofsky is making a simple request: He wants his U.S. passport to record him as born in "Israel," and not, as the U.S. Consulate decided, in "Jerusalem." Advertisement

The U.S. administration, as a matter of policy, is not willing to confirm that U.S. citizens who were born in Jerusalem were indeed born in Israel because, as was argued by the state's representative in court, the issue is "the subject of profound dispute" and Israel's claim to sovereignty over the city has never been decided.

Two facts bear mentioning: One, the U.S. Embassy is located in Tel Aviv; and two, the passport of a U.S. citizen who is born in Jerusalem will not include the word "Israel," according to State Department regulations behind the actions of the consular officials.

Zivotofsky petitioned the court based on a law passed by Congress in 2002. Among the law's requirements, Zivotofsky is arguing, is that the secretary of state list Israel as the country of origin for U.S. citizens born in Jerusalem on passports, birth certificates and certificates of nationality. But the U.S. administration refuses to recognize this.

I didn't realize that our own DOS had such a stupid policy regarding Jerusalem, ISRAEL. So much for the Zionist Neo-con conspiracy! This is absurd. Jerusalem "belongs" to Israel--period. The Arab refugees are simply a bad case of squatters. When's the de-lousing start?

That's a good point. Trying to remember anything that Bolton may have forced through after he was done berating his employees. Bringing the Iran nuke problem to light rings a bell but he was in the minority at State; i.e. he was an effective employee.

The Defartment of State has had this policy toward Jerusalem for many years, going way back to '48, when the DOS tried to be "evenhanded" by regarding Jerusalem as an "international question" needing to "be resolved later." They have been PO'ed at Israel ever since Israel refused to wither away in '48.

"Evenhanded" sounds a lot like the other PC-crap terms like multicultural, eco-friendly, etc. DOS sounds a lot like POS. I hope Israel never withers away and the Pro-Israel Christian group referenced in another post sounds like a great start. We have no greater friends than each other when it comes to confronting the evils (i.e. Islam) of the world.

This long standing U.S. policy of pretending that Jerusalem was located nowhere is ludacrous and shameless. No other country was so treated.

People are born where they are born; the name of the country in which a place is at the time on one's birth is the name of the country at the time of one's birth.

The Arabist U.S. State Department has repeatedly shown its true colors going back throughout the last century.

On one hand, the Jerusalem without a country nonsense is outrageous, and is blatant pandering to perpetually offended A-rabs.

OTOH, passports of US citizens who are born outside the US, simply name the country of birth. Therefore... By refusing to place "Israel" on the passports (birth certificates, etc.) of Jerusalem-born citizens, the dingbat State Dept. dhimmis have inadvertantly elevated Jerusalem to the position of being an entire country. Those crafty Zionists and their sneaky plots. *snicker*.

Glad I could be of service. I just finished Spencer's "Politically Incorrect Guide to Islam..." and am currently re-reading select sections. I am truly fed up with PC-establishment not seeing that this is a WAR. The Islamofacists are using the same mindset applied in the 7th century with some updates to take advantage of this century's weaknesses.
