So your contention is that if the Supreme Court were deciding a case, it ok for the Justices to cite the Federalist papers, but they should not look to the preamble of the Constitution for guidance on the intent of the Framers?
Now that if a truly interesting legal theory.
Point out where it says that a State can secede.
Even the Confederates did not put that 'right' in their Constitution.
And of course, the right to secede supersedes the rights of millions of slaves
No, we hate the Confederacy.
We love Dixie!
Do you have a link to the information you posted?
At that time the South was undereducated and many people were susceptible to the Lies of the slavers which transformed the fight for their slaves into a fight against "invaders".
Particularly revolting was the exemption from military service of large slave owners while the poor whites were drafted to fight to protect those very owners. This injustice and irrationality of the southern system and rulers reminds me most of Czarist Russia in its corruption of and destruction of the human spirit and blind fight against freedom.
Well I can't disagree about the every-day citizen fighting a war for the planters. Too bad cooler heads couldn't prevail and this whole horrid episode hashed out in the courts, but by the same token, you'll never get me to say a bad thing about the South, except Jim Crow and the Klan. My convictions are firm and un-bending. Those soldiers were fighting for a cause they thought was just and right...........sucession against a tyrannical central government. Hmm, wonder if it would work today? It hasn't gotten any better.
OTOH, he made a lot of conciliatory gestures towards the south as the president-elect that went unreported or were distorted by newspapers in the south. This made a lot of Republicans, who were hard-line abolitionists very angry. The whole thing got out of control during this period with the south voting to secede and forming the Confederacy.
Interestingly, there are parallels to this today. Appeasement, as Lincoln attempted in order to placate the South doesn't work, and the media can play a big part with their distortion of the facts.
The only problem with your contention is that there was NO tyrannical central government in 1860. Didn't exist.
Not only was the government very small but had been consistently in the hands of slaveowners or those not opposed to slavery. Only JQ Adams was an abolitionist since the Founding of the Republic. None of the Court had ever been abolitionist and only a few in Congress and they were isolated and powerless.
And the government in 1860 was tiny. It only grew in response to the needs of fielding the huge armies required to fight the war just as the Confederate government did. It shrank rapidly after the War as the armies demobilized and went home.
This issue is not about the South where I was born and raised and which I still love it is about a self-interested ruling class dragging the entire region down in a sea of flame trying to protect a long outdated economic system. That ruling class was totally responsible for the damage done the South and the chaos of the Klan later. It was also totally Democrat.
DIShonest abe lincoln & wee willie klintoon were about the same sort of POTUS. EITHER would do ANYTHING for POWER & $$$$$$$$$.

Wipe the spittle from your chin stand.
It takes a real dumbass to claim Lincoln wanted war when we was not even President when South Carolina seceded. Or to ignore the fact that the lunatic fireeaters deliberately worked to get Lincoln elected as a pretense to secede.
the BOR & particularly the 10th Amendment is to restrict the power of the central government.
that which is NOT specifically CEDED in writing to the federal government remains a power of the STATES. the 10th Amendment couldn't be more clear on this point.

the right of secession is NOT one of the powers ceded to the central government.
