Operative phrase is "Pursuant to section 302(a)(1) of the Act". No one in the Bush administration denies that FISA was bypassed in the current NSA program. I'm having some difficulty finding it, but as I recall the particulars, the act notes where it doesn't apply, and this is a reference to it.
