Considering this is the Ninth Circuit, the Scouts will lose this one. They can find another venue, probably at no greater cost. In short, the Scouts will survive. With any luck, the ACLU will not.
IIRC, even thought the lease is $1.00 per year, the local Scouting council has invested millions into upgrades of the property even though anyone is able to use it.
SCOTUS bound, and I think the ACLU is making a mistake here. Last call was a few minutes ago.
