Gonzales: Section 109 makes the exception; provision in the statute. You may say you disagree with that construction. We believe this is a possible reading of FISA and as SCOTUS has said, if you have two constructions of the statute and one would result in a constitutional issue, if the other reading makes it possible, that is the one that MUST be applied.
