Even if it was not 9-0 and even if he opposed Roberts, Scalia, and Thomas he still did the right thing. Alito has been on the court for less than 24 hours and he got this case of execution stay that was supposed to expire today. He cannot just go ahead and say yep go ahead and execute the guy without reviewing the case. He needs few days to review it in order to make a sound judgment and this tell a lot about his great demeanour and fairness.

The question seems not to be a review of the scum's conviction, but wheter death by lethal injection is, "Cruel and unusual punishment."

Alito has definitely thought this issue out before.

I hope his decision on this matter is not portending another death penalty bleeding heart---let alone anoter Souter or Kennedy.

Agreed.

No way does Alito make his first SC decision a decision to execute some killer whose case he is not even slightly familiar with. I would have done the same thing. Then I would get up to speed and make sure the killer gets the needle he deserves.

Review the case? The appeal was not about whether the perp did it or not, was about whether or not the decision was "racist". Guess you had to live in the area where a 15 year old girl was snatched from a bus stop and murdered.
