No, if he's sworn in there's a seat for him in the front row. Would like to see Mrs. Alito up there with Laura though.
The thought of Alito in the balcony with Laura is if he is filibustered today, even though he has the support of a majority of senators. If that's the case, he and his wife should be guests of the President and the First Lady.
Of course, if cloture goes through today, if he is confirmed tomorrow morning, and is sworn in soon after, Alito would be with the other justices tomorrow night. (And O'Connor would probably be a guest with Laura in the balcony.) By the way, I agree with the thought of having Mrs. Alito be a guest in the balcony.
