Byrd is different; he has said before and voted before that the President has a right to his nominees unless they are clearly unqualified. He has voted for other nominees that were filibustered and voted no on by many of the Dems. So, no, Byrd was not surprising on THAT ONE ISSUE. Otherwise he is horrible.

Byrd has made it known he is not about to politicize the whole process. He's impressed by Alito because Alito knows and understands the Constitution as written.

Byrd is against the filibuster of judicial nominees because it's nowhere to be found in the Constitution.
