If the cloture vote should somehow fail, the Republicans MUST invoke the Nuclear Option immediately. Otherwise 60 votes will have become the de facto threshold for Supreme Court confirmation. I agree.

Frist and Co. aren't going to get blindsided. This business of a filibuster is a political non-starter for the Democrats.

Dear Jumpin Jim: Should voters consider the political philosophy when they elect someone as .....oh I don't know, say a Senator to their state?
Or should a senator take money from a party to get elected, and then declare himself "independent".
