Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the Government for a redress of grievances.
Looks like the arrogance of these city pols will be met with a well deserved thunderous backlash.
On a serious note, this is what the recall process is designed for. It's time for folks to let their local, recallable, officials understand that such "takings" are not going to be tolerated. A few recalls of entire city councils or county boards will soon put an end to such crap.
We the people have the power. It's just a matter of using it.
No law...and therefore no law suit...can be brought or filed against them for simply exercising that right. If there is not more to this, then what these city officials are doing is blatantly unconstitional and tyranical.
Reading the article, it sounds more like the city is trying to get a court to rule that, despite the petition, the city council's decision is not subject to being overturned by ballot vote -- as distinct from suing the petitioners for monetary damages for the offense of doing a petition
It really makes one wonder where the ACLU is in all of this. I thought they were supposed to protect our liberties......Oh I forgot thats not their real goal..their REAL goal is to promote their aganda, Communism,Socialism and the Perverts at NAMBLA...
Did anybody notice the lawsuit wasn't analyzed? What is the city asking the court to do, invalidate the petition, strike or disallow standing, enjoin, what?
The Supreme Court may have decided that our Constitution does not prohibt cities from practicing "eminent domain." I hadn't noticed that in so doing it removed the right of citizens to say something about it, or to change it on a local level. In fact IIRC the Court specifically encouraged citizens to prohibit the practice on the local level if they wished.
Isn't that just the most awful thing.
Imagine citizens that organize to reach their neighbors...for the purpose of the Constitutional right to petition their government...abide by the Constitution.
