Of the remaining seven, five are against filibuster. That leaves a maximum of two Gang-of-14 Senators being willing to cast a vote for filibuster. None of them has expressed an intention to vote for the filibuster.

I suspect that before 2PM tomorrow, it'll be clear that 60 Senators will vote to confirm. That moots the cloture activity. In light of 60 votes to confirm the nominee, Reid and Frist are empowered to "vitiate" the cloture motion - deem it unnecessary. The effect of that would be "no cloture vote, and vote on the nominee occurs as scheduled, at 11AM Tuesday morning."

Thanks for the clarification. I am hoping all goes well, but am still amazed that the Dems cannot stop this nomination. McCain still worries me the most. He could stop the nomination for his political ambition, if he believes it would help him somehow.

Anyway, for the Dems moonbat and intellectual wing, this is the end of life as they know it. Alito doesn't believe in the wide interpretation of the Commmerce clause, and that is how the Federal Government has expanded so dramatically into every facet of life.
