Let's not get overconfident. Cloture fails when 60 Senators vote for it, not until. We need some Democrat votes to get to 60 and although some Democrats have said they oppose a filibuster, who knows what can happen over the weekend.

I actually agree, and was wondering why Alito already had a photo-op the other day with Senate's leadership (Specter, McConnel, etc).
