Filibuster is gonna fail one way or another. But yes, given 60 votes in favor of the nominee, the "cloture abuse question" becomes moot.
Another Democrat For Alito?

From AP:
Sen. Kent Conrad, D-N.D., also announced Friday he is "leaning in favor of voting for'' the conservative judge. "It is clear to me that a majority of the American people and the people I represent support his confirmation,'' he said after meeting with Alito in his office.
This may have been asked and answered but here goes.......
If the cloture vote Monday at 4:30 is held and all the gang of 14 (7) Democrats vote present instead of NO on the filibuster will it still require 60 votes to invoke cloture?
Anyone?
