I have the same feeling. Much easier to handle the hits to a few DEM Senators, than for DEM leadership to have to try to explain "why no filibuster" if/when the final vote is less than 60.I called this scenario on Tuesday.
Heck, we should get Chafee and the Maine sisters to vote no just to keep it under 60 :)

If they just withhold on how they will vote until the vote, and the Dems come up with 39 votes against, then they vote against. Alito is still confirmed but all the DUmmies will truly explode!
