Hamas: State in '67 borders is temporary solution

JPost.com Staff, THE JERUSALEM POST Jan. 22, 2006 www.jpost.com/servlet/Satellite?cid=1137605888541&pagename=JPost%2FJPArticle%2FShowFull Ismail Haniya, the top candidate on the Hamas list for Palestinian parliamentary elections, said Sunday that Hamas supports only as a temporary solution the establishment of a Palestinian states along the 1967 borders and with Jerusalem as its capital.

Haniya emphasized that Hamas does not recognize the existence of the State of Israel and maintains its vision of establishing a Palestinian state throughout all of the area west of the Jordan River.

He also reiterated that there is no chance that Hamas would voluntarily disarm as long as Israel exists, Israel Radio reported.

Violations of Electoral Campaigns Regulations Mosque Sermons Openly Call for Voting for the "Change and Reform List"

PCHR observers have reported that dozens of Imams committed campaign violations during Friday Prayer sermons on 20 January 2006. The Imams openly called upon worshippers to vote for the Change and Reform List candidates in their districts. The Change and Reform List is affiliated to Hamas.

The violations included:

· Al-Sousi Mosque in al-Shati refugee camp in Gaza City: The Imam called for voting for the Change and Reform List, and defamed other lists. Some worshippers objected and a commotion ensued in the mosque. Some of the worshipers brought the Imam down from the pulpit before he finished the sermon. The situation almost deteriorated into a fight inside and outside the mosque.

· A mosque in al-Zahra Town, south of Gaza City: The Imam called for worshippers to vote for the Change and Reform List. Some of those attending became angry and one hurled a water bottle at the Imam. A commotion ensued inside the mosque.

These acts violate Elections Law No. 9 of 2005, which prohibits the use mosques for campaigning activities, including hanging posters on walls and using sermons to call for voting for certain candidates or parties.

PCHR calls upon all candidates to stop such campaigning activities and to comply with the regulations of election campaigns to ensure the fairness of elections.

PCHR Receives a Letter from Hamas Denying Violations of Campaigning Regulations

On Saturday, 21 January 2006, PCHR received a letter from the Islamic Resistance Movement (Hamas) indicating the movement's "eagerness to abide by campaigning regulations and all legal practices during the electoral process." Hamas quoted the second paragraph of the elections law, regarding, "abstaining from holding election rallies and public meetings in mosques or churches." The movement considers that "the legal text is clear" and "contains no ambiguity in prohibiting campaign rallies and public meetings in mosques."

The letter comes in response to the Centre's earlier update on violations of campaigning regulations, regarding the transmission of Al-Aqsa local television station, since the 9th January 2006, from an antenna on the 3rd floor of Al-Bashir Mosque in the Tal El-Za'tar area of Jabalia. The station aired campaign propaganda for the "Change and Reform List," which is a violation of the elections law.

PCHR reiterates that utilizing mosques and other public institutions in campaigning, regardless of its form, is a violation of the law. The Centre repeats its calls to all parties to abide by campaigning regulations, and to refrain from using mosques during the election campaign.

Subject: Update No. 4 on Violations of Electoral Campaigns Regulations

We follow with interest your comments, and value your sincere efforts in monitoring the electoral process. With regards to PCHR's update No. 4 on violations of electoral campaigns regulations that requested from Hamas to abide by campaigning regulations, we are very eager to abide by campaigning regulations and all legal practices during the electoral process.

With regards to Paragraph 2 in Article 64 in the Law #9 for the year 2005 on general elections, the law stated, "abstaining from holding election rallies and public meetings in mosques or churches." It is an unambiguous legal text that cannot be misinterpreted. It limited the prohibition to holding campaign rallies and public meetings inside mosques. This was confirmed by Mr. Ammar Duweik, the Executive Director of the Central Elections Committee.
