I thought the point you had made was that one cannot sue the government. That is not true as can be seen in Kelo where homeowners sued the New London city government. All that is necessary is for government not to push soverign immunity and any level of government can be sued. It happens very frequently. The Feds have been sued over ANWR and other issues recently.
