Testimony in a hearing on whether to dismiss charges against two volunteer aid workers charged with violating federal immigration law wrapped up Tuesday, and now U.S. Magistrate Judge Bernardo P. Velasco is weighing a decision.
Jeff Rogers, the attorney for defendant Daniel M. Strauss, said two weeks would be about average for the judge to issue a decision, though since Velasco has been ill Rogers speculated it could take longer.
Velasco's decision will be a recommendation to U.S. District Judge Raner Collins, who then is expected to rule on whether the case will go to trial. The original trial date of Tuesday was postponed, and no new date has been set.
Shanti A. Sellz, 23, and Strauss, 24, face charges that they knowingly and intentionally conspired to transport illegal entrants while volunteering for the local faith-based No More Deaths movement, which during the summer provides food, water and medical aid to people entering the United States illegally on foot. The pair say they were taking three entrants to get emergency medical care when they were arrested July 9 en route from the Arivaca area to Tucson.
Prosecutors say the illegal entrants were not seriously ill. But Sellz and Strauss say they contacted a nurse and a doctor before transporting the men and that they were following No More Deaths protocol, which calls for medically evacuating illegal entrants to Tucson if they are seriously ill. Prosecutors say the protocol was never approved by federal officials and that Border Patrol officials had warned religious leaders in April that they'd risk arrest if they transported migrants.

Neighbor complaints bring action
Tensions are rising in a neighborhood where border crossers who gather on a street corner south of Downtown to be hired for the day mix with dope dealers, alcoholics and thieves.
Neighbors - including Southside Presbyterian Church, home base of the No More Deaths border activists - have complained to police about the day laborers.
Those complaints culminated in the arrest of 20 illegal border crossers by U.S. Border Patrol agents at South Ninth Avenue and East 23rd Street on Monday. Such operations by the Border Patrol are rare in the area.
These two college dweebs will learn to like Bubba. A real educational experience. No sympathy here. They cant even live with their own excrement, and have to call in the BP to rid them of those they bring in. What a bunch of hypocrites.

It should be made a felony for Criminals who overstay their visas and Invaders.
I believe we should give amnesty to these poor CRIMINALS or INVADERS.
This should be a 2 week amnesty to get the heck out of our Country.
The ones who ignore this amnesty should be buried in a tent city jail and fined $10,000 or buried elsewhere.
All aiders and abettors of these CRIMINALS or INVADERS should get 1 year in a tent city jail and a $10,000 fine for each CRIMINAL aided.
Those in government should be the first ones charged.

Sellz and Strauss were driving three illegal immigrants from Arivaca to a church in Tucson when they were arrested.

Collins, who will decide whether Sellz and Strauss should be tried.Judge Velasco: "The issue, therefore, is whether the illegal aliens treated at Southside Presbyterian Church and thereafter allowed to melt into Tucson, Arizona, have been assisted 'in furtherance' of their illegal entry. The answer is yes."

I disagree slightly with the Judge. If these two were rendering aid , why did they drive past the emergency room in Green Valley? Why did they also bypass St. Mary's Hospital? They took their "critically ill" illegals past two locations where proper medical aid could have been rendered. Charges should be filed for that too.

I've been following this case for a while now. Do you want me to ping you when the other judge makes the decision about whether or not they should be brought to trial?

I hope they make these 2 liable for all the medical care, welfare, social services, jailing, legal counsel, transport and repatriation of all the illegals they brought in. They were in effect acting as their "sponsors".

My hope is the lawyers suck them dry, No more "no more borders".
It will at least bring them down a notch or two in arrogance, maybe.
