SALIM AHMED HAMDAN V. DONALD RUMSFELD
January 12, 2006
The U.S. Government files a brief with the Supreme Court seeking to dismiss a Guantanamo detainee's case from the Court's docket. The government argues that when Congress passed the Detainee Treatment Act of 2005 (signed into law on December 30, 2005), it meant that "alien[s] held in military custody at Guantanamo Bay" could not seek writs of habeas corpus in federal court challenging the legality of their military detentions.
