For what? The Democrats controlled the Senate when Ginsberg and Breyer were confirmed. The only justices on the Court that were confirmed by Republican-controlled Senates were Roberts and O'Conner/Alito.
Even then, only 4 Republicans voted against Ginsberg, in a 96-4 vote. What Leaky doesn't realize is, neither Ginsberg or Breyer were filibustered or held up in committee.
