State high court won't delay Allen execution

The California Supreme Court today moved condemned inmate Clarence Ray Allen a step closer to execution, rejecting his latest bid for a reprieve based on the argument he is too old and sick to be put to death.

In a brief order, the court without explanation unanimously refused to delay Allen's execution, scheduled for shortly after midnight Monday. Allen can still hope for clemency from Gov. Arnold Schwarzenegger, who has yet to make a decision on his fate, and also try last-ditch legal appeals in the federal courts.

But time is running out for Allen, who has lost repeated rounds in the courts since being sentenced to die in 1982 for orchestrating three Fresno murders while he was already serving time in prison for another murder *** In both his legal arguments and bid for clemency, Allen maintains his age and deteriorating medical condition would make it cruel and unusual punishment for him to be executed. Allen had a major heart attack last fall, suffers from diabetes that has left him legally blind and uses a wheelchair.

Prosecutors and the victims' families have opposed Allen's request for a reprieve, saying his age and medical condition are simply a byproduct of the state's lengthy appeals process in death penalty cases. A jury convicted Allen of enlisting a paroled prison inmate to murder witnesses that had put him behind bars, resulting in the 1980 shotgun deaths of Bryon Schletewitz, 27, one of those witnesses, and two bystanders, Douglas White, 18, and Josephine Rocha, 17. Billy Ray Hamilton, who committed the murders, is also on death row

Funny how the libs, rap stars, pope, aclu, jesse are strangely silent on this one. Racial bias? Do black defendants (i.e. Tookie) deserve more consideration than white ones?

Where's the logic? How could one "be too old and sick" to die? Normally those words are said about somebody young and healthy.

If I've learned one thing over the years from activists it's this: Whites are ALWAYS guilty, blacks are ALWAYS innocent.

That's not racism, cause I'm saying it about the "majority" and the "majority" is never hurt by racial bias. Besides - the people at Harvard say discriminating against whites is okay.

The endless appeals take their toll in time, and when the 20+ years of appeals are done, then "the inmate is too old and sick to die"?????

Give me a break. Total BS.

Yep, to old or sick to die, an oxymoron if I ever heard one. We will cure his ills shortly. We need to go through death row and start putting these people where they belong, in the ground. I believe in one appeal, or 6 months to exhaust all appeals and then kill the POS.
