I agree with you that we should have been standing behind Delay a lot more than we have. He has done more for the party than any ten congresscritters.

In the last election we did notice the dems doing all kinds of verbal contortions to keep from admitting they are "liberal"...but,

like you, I hear the word "progressive"..and I automatically recoil...it sigifies "socialism" much better than "liberal" does.

As for the Republicans...they need to stop worrying about their labels...and worry more about their BACKBONES.

Informational biased group. These people can be counted on to present ONLY the Congressional viewpoint. They will be VERY quick to assert anything that proclaims the dominance of the Congress. Would take anything they say with a HUGH grain of salt since they will ONLY present Congress's viewpoint. This is what the Congress thinks Its powers should be, that does NOT make them so. The Executive is a CO equal branch of Govt despite the Congress lovers attempts since Watergate to make it a subsidary of Congress. The "factually inclined" may want to keep in mind that these people are the Congressional ADVOCATES not an unbiased source of information. Does not mean their info is false just means they are advocates for a point of view NOT reporters of unbiased information

I understand Delay's decision to get out of the way and not be a distraction for the work that has to be done. Having said that, I continue to support Tom Delay and I am convinced he will not be convicted of anything.

Delay, on FNS, said he does nothing that has not been vetted through his lawyers and the House Ethics Committee because he knows the Democrats are laying in wait to get him. I believe that and believe him.

Under his analysis, Congress can make NO statute that limits a president's warime powers

It's not his premise, it's the Supreme court (and many other courts) ruling that Congress cannot limit an inherent Constitutional power by legislation. Congress cannot amend the Constitution by legislation, only through the specified amendment process.

The argument therefore has to be whether the power exercised is inherent and stems from the President's constitutional authority or whether it is derivative of that power. A derivative power can be "channeled" by legislation, but an inherent power cannot be limited.

All of the case law, and even the FISA law itself, specifically states that it cannot abridge the president's power in this regard. All of the Presidents since FISA have maintained this and Carter, Reagan and Clinton have all exercised this power in exactly this same manner without successful challenge. Clinton even used this power for purely domestic warrant-less wiretaps after the OKC bombing. That makes this settled law. If anyone bitches to Alito this week about this point he merely trots out that bon mot and the argument is over.

Actually, this may be harsh...but, some of the threads on FR about Delay's problems seem to be filled with "trolls" that have been here for a long time...

I have been disappointed and surprised at how many I have seen that have been, IMHO, premature in their eagerness to tar and feather Tom Delay.

Understood. Plus, saying you're not liberal makes it so. Consevatives don't have a problem being conservative. We tend to wear it as a badge of courage as liberals keep running away from what they are.

BTW, everyone, Bob Novak is on FNS. First time for him as far as I know.

He may have the tanned look from his Second home in Florida or his ancestry. He looks Italian to me,but not with that name. LOL! Maybe Mcdermott is finally going to pay up and he has suddenly become Wealthy. I have not heard him speak recently, but he has kind of a "radio" voice, and nonchalant, says a lot with his eyes, and does not make enemies like other conservatives can when they speak harshly. i hope he wins and turns into a freaking democrap eating pit bull.
