While it doesn't have any real practical application today, he is, technically, correct. A peace treaty was never signed. A cease fire was signed at Appomatox whereby in return for a cessation of combat Lee's troops were allowed to return home, would not be prosecuted in a trial, and were allowed to keep one rifle and one horse.

Why would the Union sign a peace treaty with a rebellion? Peace treaties are only signed between sovereign parties; but the Union never recognized the confederacy as a sovereign nation.
