He's 17 that would be legal in some states.... this isn't nearly like the case with the 40 year old and the 12 year old... she is stupid and should be fired but I don't see the point of taking up prison space with her.
I know where you're coming from, but I disagree with your premis. This woman was 35, he was 17. Besides the "sick" factor here, its IS against the law. If we start watering down sentencing because some states are more permissive than others, the respect for the law becomes a joke. Absolutely no teacher in K-12 should ever under any circumstance be allowed to have sex with a student. Period. I don't care if you have a 19 year old on his third try at senior year. Teachers are in a position of authority and like any other workplace, authority is too easily abused and should be prohibited.

It's legal in California, too, but it's against the law for teachers to have sex with minor students. That's why the unlawful sexual intercourse charge.
Otherwise, 17 year olds can rut as they choose.
